3.4 After submission of the order, CASAHITO will share details of Your purchase through an email to confirm that CASAHITO has received the order and is processing it (the " Order Confirmation "). However, please note that this does not mean that your order had been accepted. Our acceptance of your order will take place as described in clause 3.5. 4.1 CASAHITO invites You to check the availability of products offered for sale on the Site at the time of purchase. Products sold by CASAHITO on the Site may be subject to stock limits, and CASAHITO does not guarantee that they will always be available.
4.2 Depending on availability, ordered Products will be shipped to You within 48 hours. In the event of a high demand of the ordered Products, we will try to ship the order to You within 7-10 days. Furthermore, if the ordered Product is temporarily unavailable or is listed as a bulk order, we will try to ship the same within 30 days. 6.5. Currently we do not offer cash on delivery service. All orders are confirmed post successful payment online through approved payment partners.
7.1. Following Order Confirmation, Your ordered products will be dispatched to the address provided during the purchase process. For security reasons, CASAHITO will not ship any order to a P.O. Box or accept any order where it is impossible to identify the individual private recipient of the order, and its address.
7.2. All purchases will be delivered by CASAHITO's selected courier service (hereinafter, "Courier") between Monday and Friday excluding Saturdays, Sundays and local or national holidays, after the Order Confirmation is sent to You, on the basis of the indicated availability. CASAHITO will not be responsible for delays that are unforeseeable and/or attributable to the Courier service provider.
7.3. In the event You do not receive the product(s) you purchased within 25 business days following receipt of the Order Confirmation, You can e-mail customer service at at email@example.com. CASAHITO reserves the right not to respond to any such inquiries sent after 30 days from receipt of the Order Confirmation by You.
7.4. Please note that estimated delivery times are to be used as a guide only and commence from the date of dispatch, CASAHITO is not responsible for any delays caused by Courier or destination customs clearance processes.
7.5. Your Order may be subject to import duties and taxes which are applied when the delivery reaches your country. Please note that we have no control over these charges and we cannot predict their amount.
7.6. You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order.
CASAHITO insures each purchase during the time it is in transit until it is delivered to Your specified delivery address. We require a signature for any goods delivered, at which point responsibility for Your purchased goods passes to You. If You have specified a recipient who is not You for delivery purposes (for example as a gift) then You accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by CASAHITO, and transfer of responsibility in the same way.
9. SHIPPING INFORMATION:
9.1. CASAHITO includes the shipping cost in product price to all addresses for the order.
9.2. Please note that we require a receiving signature by an adult/ major (as per the applicable laws) for all deliveries and therefore do not ship to PO Boxes.
9.3. We are unable to ship to FPO/APO addresses.
9.4. We do not offer any expedite shipping.
9.5. We will not be delivering orders on the national holidays or any such other day prescribed as a holiday by the respective government/local authority.
9.6. CASAHITO will only deliver Your package to the address that was requested when Your order was placed. We don’t re-route any packages.
10. CANCELLATION POLICY:
10.1 If you are a consumer, you have a legal right to cancel a contract during the period set out below in clause 10.3. This means that during the relevant period if you change your mind or decide for any other reason that you do not want to receive or keep a Product, you can notify us of your decision to cancel the contract and receive a store credit.
10.2 Your legal right to cancel a contract starts from the date of the Dispatch Confirmation (the date on which we e-mail you to confirm our acceptance of your order), which is when the contract between us is formed. Your deadline for cancelling the contract then depends on what you have ordered and how it is delivered, as set out in the table below:

Example: if we provide you with a Dispatch Confirmation on 1 January in respect of Products to be delivered at regular intervals over a year and you receive the first delivery of your Product on 10 January, you may cancel at any time between 1 January and the end of the day on 24 January. 24 January is the last day of the cancellation period in respect of all Products to arrive during the year.
10.3 To cancel a contract, you just need to let us know that you have decided to cancel. The easiest way to cancel the contract is to log in to casahito.com and request a cancellation in the "My Order" section, mentioning that you wish to cancel your order pursuant to clause 10. Once we have received your cancellation request we shall send you a confirmation email. After you receive the confirmation email, please would you (if you have already received items) return the Products to us in their original packaging, with all necessary tags and documents in one of the ways set out in clause 11.3 or 11.4
10.4.1 refund you the price you paid for the Products in the form of store credits. However, please note we are permitted by law to reduce your refund to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop. If we refund you the price paid before we are able to inspect the goods and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount. The shipping cost, insurance cost, duty fee, VAT and other taxes shall also be subject to deduction from the order amount.
10.4.2 make any refunds due to you in the form of store credits as soon as possible and in any event 14 days after the day on which we received the Product back from you or, if earlier, the day on which you provide us with evidence that you have sent the Product back to us. For information about how to return a Product to us, see clause 11;
10.5 If you have returned the Products to us under this clause 10 because they are faulty or mis-described, we will refund the price of the Products in form of store credits in full, together with any applicable delivery charges, and any reasonable costs you incur in returning the item to us.
10.6 If a Product has been delivered to you before you decide to cancel your Contract:
10.6.1 then you must return it to us without undue delay and in any event not later than 14 days after the day on which you let us know that you wish to cancel the Contract. You can return it to us at our warehouse. Please see clause 11.3 and 11.4 for further details;
10.6.2 unless the Product is faulty or not as described (in this case, see clause 10.7), you will be responsible for the cost of returning the Products to us. If the Product is one which cannot be returned by post, we estimate that if you use the carrier which delivered the Product to you, these costs should not exceed the sums we charged you for delivery.
10.7 Because you are a consumer, we are under a legal duty to supply Products that are in conformity with this contract. As a consumer, you have legal rights in relation to Products that are faulty or not as described. These legal rights are not affected by your right of return and refund in this clause 10 or anything else in these T&C’s.
11. RETURN POLICY
11.1 In addition to Your statutory right to cancel the contract under clause 10, if You are not completely satisfied with your purchase, You can return the ordered products, within 30 days from the date of receipt of the Product(s) purchased on the Site. Please note that at this time Casahito only offers store credit in the event you wish to return any Product or Products, as further described below in clause 11.6, 11.7, and 11.8.
11.2 To return the products/order to CASAHITO, follow the procedure described below:
i. Login to casahito.com and request a return application within 10 days of delivery in Your ‘My Order’ section, mentioning the reason for Your return to get Your Order Return Number ("ORN").
ii. Make sure the merchandise You return is in its original condition, all tags and packaging included. Check the presence of the label and commercial documents accompanying the products within the package.
iii.On acceptance of Your return request we will share with You a confirmation email.
iv. Upon receipt of the confirmation mail, please contact the courier of Your choice and send the order in its original packing, with all necessary tags and documents to our defined address in section 11.3 or 11.4 within 30 days of delivery.
11.3 Returns from UK
(i) all shipments from UK may be returned directly to our designated Post Box at ROYAL MAIL at Your expense; or
(ii) You may return the products to CASAHITO Warehouse at Your expense; or
11.4 Returns from USA, Canada and Australia:
All shipments can be returned to CASAHITO Warehouse at Your expense; or
11.5 Please note that CASAHITO will not be responsible for returns which are returned to incorrect address.
11.6 While requesting for return you shall receive store credit in the order return section on the Site.
11.7 Return for store-credit will be processed immediately after approval from CASAHITO. A store-credit (equal to order-amount deducted by the shipping cost, insurance cost, duty fee, VAT and other taxes) will be added to the Your Account, provided that products are returned unused, unwashed and in the same condition in which they were delivered, with all original labels attached including the anti-counterfeiting label, and complete with all parts and accessories using their original packaging.
11.8 A store-credit (equal to the order-amount after deducting shipping cost, insurance cost, duty fee, VAT and other taxes, to the maximum extent permitted by applicable law) will be added to purchaser’s CASAHITO account (email account), provided that the conditions described under sections 11.2 and 11.3/11.4 above have been met. You can use your store credit to purchase products on the Site. In case of return of products purchased as a gift (i.e., products shipped to a recipient different from the person who made the payment), the store-credit will be issued to the person who made the payment. Store credit issued against returns/faulty goods can only be used for 6 months beyond which it will expire, to the maximum extent permitted by applicable law.
11.9 CASAHITO reserves the right to inspect the product(s) returned and to refuse the return of those product(s) which do not comply with the requirements specified. You agree that the decision of CASAHITO with respect to such determination shall be final.
11.10 CASAHITO will not be liable for refund for Products which have not been received by CASAHITO as a consequence of loss, theft or damage not attributable to CASAHITO.
11.11 Currently we do not offer the facility of product exchange. The order can be returned for store-credit.
11.12 Repeated Returns: We offer a flexible returns policy to make Your online shopping experience even easier. However, we do monitor the number of returns made and may refuse to accept orders at our discretion if goods are returned repeatedly under this Clause 11. For the avoidance of any doubt, this clause 11.12 does not apply to cancellations or returns pursuant to clause 10.
11.13 Faulty Goods: Goods are faulty if they are received damaged. Items that are damaged as a result of normal wear and tear are not considered to be faulty. You can seek refund in the form of store credit after the product is returned in accordance with the Returns Policy.
11.14 Late Returns: In case you wish to return the order, you should file a request on the Site within 10 days of delivery. Please do ensure the same is dispatched and received at the CASAHITO Warehouse within 30 days of Your receipt of the products. In case, Your return request is outside the mentioned timeframe, CASAHITO reserves the right to reject the same.
11.15 Important Information:
- We have made every effort to showcase as accurately as possible the colours of our products that appear on casahito.com. However, as computer monitors vary, we cannot guarantee that your monitor's display of any colour will be completely accurate.
- We ensure that all items are quality controlled and checked for any faults before they are dispatched to You. Should You receive an item that is not in perfect condition please contact us immediately.
- Please send all items You wish to return from an order in the same shipment to ensure Your return is processed as quickly as possible.
- Items should be returned in their original packaging to ensure they are adequately protected in transit. CASAHITO will not be liable for any damage caused during return.

12. CONFORMITY OF ORDERS
12.1 Products received on order must be checked by You at the time of delivery to ensure that they correspond to the products You ordered.
12.2 Any variances identified at the time of delivery, including any tampering or damage to the packaging, damage to the products, missing items, non-conformity to the products ordered, defective products, etc. (hereinafter "Defects"), can be indicated by You directly to the Courier by inserting a written and signed comment on the feedback form. In such circumstance You will not be required to accept the products and may return them directly to the Courier.
12.3 In the event that any Defects are identified after delivery, then You may return the product to CASAHITO following the procedure described under Section 11.
13. CHANGES AND CORRECTIONS
13.2 We will make reasonable efforts to display accurate and timely information about products on the Site. However, there may occasionally be typographical errors, incorrect statements or omissions regarding the description of the product, the price, any promotions, offers and the availability of the product concerned (hereinafter "Errors"). CASAHITO reserves the right, at any time and without notice to You, to correct such Errors, to change or update information, to revoke offers containing such Errors and to cancel any order at any time prior to shipment. In the event that Your credit card is charged for no Products in order, You will be promptly informed by CASAHITO at the email address provided during the purchase process registration and a refund will be issued to Your credit card within 30 days without any interest or any damages/ compensation for that period or for any further time taken in refund and no claim of any harassment/ loss caused shall be made against CASAHITO.
13.3 All changes and/or corrections mentioned above will apply only to purchase orders submitted subsequent to the date of the change or correction made by CASAHITO. Unless CASAHITO decides, in its sole discretion, to cancel an order or You accept to re-confirm the order, You will be charged immediately the prices appearing on the Order Confirmation after a successful transaction.
14 DISCLAIMER OF WARRANTY
14.1 The Products which are considered faulty can be returned free of cost to Casahito. Casahito does not offer any other express or implied warranties with respect to the products except those statutorily required under the applicable law.
14.2 Additionally, please note that any statutory warranty does not apply to any defect in the Products arising from:
i. fair wear and tear;
ii. wilful damage, abnormal storage or working conditions, accident, negligence by you or by any third party;
iii.if you fail to operate or use the Products in accordance with the user instructions;
iv. any alteration or repair by you or by a third party who is not one of our authorised repairers.
14.3 CASAHITO MAKES NO EXPRESS REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING THE PRODUCTS, THE ACCURACY OR COMPLETENESS OF INFORMATION ON THIS SITE OR THE CONDITION, FEATURES OR AVAILABILITY OF PRODUCTS DESCRIBED OR OFFERED FOR SALE ON THIS SITE. CASAHITO DISCLAIMS ALL IMPLIED WARRANTIES AND REPRESENTATIONS OF ANY KIND REGARDING THE PRODUCTS OTHER THAN ANY WARRANTIES THAT IT WOULD BE UNLAWFUL TO DISCLAIM..

15.3 THE AFOREMENTIONED LIMITATIONS OF LIABILITY SHALL APPLY TO ANY LOSS OR DAMAGES, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY, WHETHER DERIVED FROM CONTRACT, TORT, INCLUDING, WITHOUT LIMITATION, STRICT LIABILITY AND NEGLIGENCE, OR ANY OTHER LEGAL THEORY, EVEN IF CASAHITO WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF WHETHER ANY OF THE LIMITED REMEDIES HEREUNDER FAIL THEIR ESSENTIAL PURPOSE. YOU ACKNOWLEDGE THAT THE DISCLAIMERS AND LIMITATIONS HEREIN ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN THE PARTIES.
15.4 WE ONLY SUPPLY THE PRODUCTS FOR DOMESTIC AND PRIVATE USE. YOU AGREE NOT TO USE THE PRODUCT FOR ANY COMMERCIAL, BUSINESS OR RESALE PURPOSES, AND WE HAVE NO LIABILITY TO YOU FOR ANY LOSS OF PROFIT, LOSS OF BUSINESS, BUSINESS INTERRUPTION, OR LOSS OF BUSINESS OPPORTUNITY.
16 APPLICATION OF LIMITATIONS AND DISCLAIMERS
17 FORCE MAJEURE
It is agreed that CASAHITO shall not be responsible for any failure or delay on its part in performing any of its obligations or for any loss or damage, cost, charges and expenses incurred or suffered by You by reason of such failure or default or delay caused due to any force majeure conditions, acts of god, laws and regulations of the Government, strikes, lock-outs, riots, violence, war or any other cause beyond its control.
You agree to indemnify, defend and hold harmless Casahito, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use this Website or your breach of the Terms of Service.
19 THIRD PARTY RIGHTS
This Contract is between you and us. No other person shall have any rights to enforce any of its terms. However, if you are a consumer, the recipient of your gift of a Product will have the benefit of our warranty at clause 16, but we and you will not need their consent to cancel or make any changes to these Terms.
